1.General Terms
- Agreement: This agreement coordinates the relationship between the client and Yona Photography for all photography services.
- Acceptance: By booking a session or using Yona Photography’s services, the client agrees to these terms and conditions.
2.Booking and Payments
- Booking Confirmation: Booking your session through any communication channel with Yona Photography is confirmed once you pay the deposit. You should not expect to receive a confirmation email.
- Payment Methods: Bank transfer through Abu Dhabi Islamic Bank is accepted or cash. If you have any specific preferences, let us know. We can handle this.
- Package Offerings: Package details and offerings are subject to change and you will be informed before booking.
Cancellation and Rescheduling:
- Clients may reschedule their session anytime.
- The deposit is non-refundable, regardless of the reason for cancellation. (Check Sickness below in the terms for exceptions).
- Cancellations made within 36 hours of the scheduled session date will result in forfeiture of the deposit.
- Rescheduling is subject to availability and may incur additional fees.
3.Photo Session
Session Duration
- Each photo session is typically scheduled for up to 2 hours, depending on the specific package chosen and the baby’s mood and cooperation.
Late Arrivals- for Studio Visits
- If a client arrives more than 15 minutes late for their scheduled studio session, Yona Photography reserves the right to:
- Reschedule the session to a later date, subject to availability.
- Shorten the session duration, resulting in fewer images.
- Maintain the original session time, but charge a late fee.
Props and Outfits
- Yona Photography provides a variety of props and outfits for the session.
- Clients are welcome to bring their own props or outfits, but please coordinate with the photographer in advance to ensure compatibility.
4.Image Usage
Copyright:
- Yona Photography retains all copyrights to the images taken during the session.
- Clients are granted a non-exclusive, personal-use license to download and print photos for their own, friends’, and relatives’ private use.
- Sale, publication, or any commercial use of the photographs is strictly prohibited without prior written permission from Yona Photography.
- Any alteration of the images is forbidden except by Yona Photography.
Sharing with Professionals:
- Without Yona Photography’s written consent, clients may not share unedited or edited copies of the images with other professional photographers or services.
- If permission is granted, only watermarked versions of the images can be shared and the recipient must provide a link back to Yona Photography’s website.
5.Image Storage
- Yona Photography will store digital files for two years after the session.
- Clients are encouraged to download and back up their images promptly.
- Yona Photography can delete all digital files associated with a session upon request.
6.Delivery of Photos
Turnaround Time
- Digital Images: Clients will receive a digital gallery of edited images within one month of the photo session.
- Printed Products: The delivery time for printed products may vary depending on the items ordered and the volume of work. Clients will be provided with an estimated delivery time upon placing their order.
Photo Selection
- Yona Photography will carefully select and edit the best images from the session.
- Clients will receive a digital gallery containing all edited and unedited images.
- Clients can request specific edits during the session, such as removing birthmarks or other minor details.
7. Fragile and Large Items
Handling and Shipping:
- Yona Photography takes extra care when handling fragile items like framed or acrylic prints. These items will be packaged securely to minimize the risk of damage during shipping.
- Yona Photography will assess the most suitable shipping method for large-format prints based on size and weight.
- Additional shipping charges may apply for oversized items.
Delivery and Acceptance:
- Upon delivery, clients are responsible for inspecting the items for visible damage before signing for acceptance.
- If the packaging or the items themselves are damaged, clients should refuse delivery and contact Yona Photography immediately.
- Any damage claims must be reported within 48 hours of delivery.
Return Policy for Fragile and Large Items:
- Returns of fragile or large items are subject to the following conditions:
- The item must be returned in its original packaging and condition.
- Returns must be initiated within 7 days of delivery.
- Clients are responsible for return shipping costs.
- A restocking fee of 20% may apply.
8.Sickness Policy
Client Responsibility
- The client acknowledges that a baby’s well-being is paramount.
- The client must inform Yona Photography immediately if the baby exhibits any signs of illness (fever, cough, congestion, etc.) within 48 hours before the scheduled session.
- Yona Photography reserves the right to reschedule the session at no additional cost to the client if the baby is unwell.
Rescheduling
- If the client cancels due to the baby’s illness within 36 hours of the session, the standard cancellation policy (deposit non-refundable) applies.
- However, Yona Photography will work with the client to find a suitable alternative date within 3 months, subject to availability.
Safety Measures
- Yona Photography prioritizes the health and safety of all clients, particularly newborns.
- The photographer will wash hands thoroughly before and after each session.
- Sanitizing wipes and hand sanitizer will be readily available during the session.
- Yona Photography reserves the right to wear a mask during the session if the baby shows any signs of illness upon arrival.
9.Printed Products
- Payment and Delivery: All orders for albums, reprints, products, and enlargements must be paid for in full when placed. Print delivery may take up to four weeks.
- Quality Assurance: Yona Photography uses high-quality printing labs and ensures consistent color accuracy and image quality.
- Client Responsibility: Clients are responsible for the color balance and quality of prints reproduced using third-party printers.
10.Sales and Offers
- Promotional Pricing: Yona Photography reserves the right to offer promotional discounts or sales on sessions or digital files at certain times throughout the year.
- No Retroactive Discounts: If you have already purchased a session or digital files at full price, you will not be eligible for retroactive discounts or refunds based on subsequent promotions or sales. This includes gift vouchers and bookings.
11.Refund Policy
No Refunds: Generally, all session fees are non-refundable.
- Exceptions: Any exceptions to the refund policy, such as for illness or unforeseen circumstances, are outlined in the sickness section above.
- Damage or Loss of Photos: We are not responsible for lost or damaged prints once delivered.
12.Liability
Personal Belongings: We are not responsible for any personal belongings lost or damaged during the session.
13.Privacy Policy
Data Protection: A reference to Yona Photography’s Privacy Policy is described in the Privacy Policy page.
14.Changes to Terms
- Modifications: Yona Photography reserves the right to modify these terms and conditions.
- Notification: Clients will be notified of any changes.
